Thanks, 2018, 5 more years... Gene should of just taken a plea deal and he would of done maybe 12 to 15 years. Similar to the deal John Gambino took and he admitted to selling over a thousand pounds of heroin on top of many other serious charges including murder and racketeering. These guys get hammered at sentencing. Unless your positive you can beat the case in court it's just smarter to take a plea deal. Didn't John tell Gene not to cop that plea? I think I read that somewhere. If that's the case you do what the boss tells you and that's that. Not much choice really.

That's true, but I have to tell you that Tony Megale defied a direct order from Gotti back in '89 and not only took a plea, but he admitted to being a member of a "criminal organization" as part of that plea (although I don't think he specifically had to name the Gambinos). Gotti went nuts, but a few months into Megale's sentence Gotti was arrested in his final case. He had bigger problems than Megale at that point. And Megale went on to become underboss after John died. So there you go. I'm just saying, shit happens in that life that you just can't count on, and defying a boss doesn't always get you killed. But generally speaking, it ain't too healthy a decision .

No doubt the prosecutors were out for Gotti blood at the time and they couldn't get John so they made do with his brother Gene.
The comparison i made to John Gambino's case was that after Gambino's first mistrial both sides agreed it was in their interest to make a plea deal and Gambino and his brother got what i think is a pretty good deal if you read all the charges they were hit with. 15 years for running a huge international heroin network where they admitted to selling over 1,000 pounds of heroin, first degree murder, racketeering, gambling, loan sharking, jury tampering and the list goes on and on. So 15 years for all that is a good deal in my opinion. If Gambino was found guilty of all those charges after a trial he would of gotten some insane amount of time (easily 50+ years) at sentencing and would of died in prison. Instead he did his 15 and is out with his family (both of them).
If my memory is correct Gene Gotti had 2 mistrials before he was finally convicted the third time. I have a hunch he could of worked himself a pretty good deal before that third trial if he wanted to. I don't know if he was offered a deal or not, but i think his lawyer could of made it happen if he wanted it. In my opinion he could of made a deal to do 10 to 15 years right before the start of that 3rd trial, but he listened to his brothers orders, fought it and got 45 or 50 years instead. If he knew the feds had him "dead to rights" as another poster here put it then personally i think it would of been the smart move. You can only get to the jury so many times. I think the prosecutors after 2 mistrials would of been open to it. But maybe Gene really thought he could beat the case, who knows.
