They can't because they have to prove damages. So if he says Merlino is a mobster, so have others. If he repeats a story about a person and embellishes and lies about them, he could be found to have lied, but the person suing would have to prove it ruined their reputation. If they had ever been arrested, had an article written on them, the judge or jury would say there was no damage. Bernstein is scum, no doubt, He gets away with it though,
If tomorrow he says Michael Franzee and Michael Deleonardo killed Carmine Galante, and Franzese is running the Mafia today, they could not sue and win. That is why Scott Scumstein and Capeci plus the others get away with just about anything.

When the movie "Donnie Brasco" came out,John "Boobie Cerasani sued Sony and Tristar pictures,for libel damages based on his portrayal as a murderer in the film. Early test screenings of the movie used his real name,but the theatrical release used the pseudonym "Paulie". Cerasani was found not guilty of the charges brought as a result of the movie,after which he filed the suit. Judge Denny Chin of the Federal District Court in Manhattan dismissed the suit stating that Cerasani was "the exceptional libel-proof plaintiff" whose reputation "is sufficiently tarnished,that at most he could collect nominal damages"
That is important, the damages collected, if any, wouldn't be enough to cover expenses. Plus it's tough for anyone to win a libel suit, almost impossible in the case of the people Capeic, Bernstein , and others could be lying about,. They also use the defense that they are quoting sources.
