If Scott Bernstein is the liar people say he is, why hasn't he been sued or arrested? He actually names names, places, and events. Seems to me like the alleged mobsters he talks about could make a killing off of his lies alone. I wish someone would go public and make up lies and false claims about me like that, I'd be a millionaire.

They can't because they have to prove damages. So if he says Merlino is a mobster, so have others. If he repeats a story about a person and embellishes and lies about them, he could be found to have lied, but the person suing would have to prove it ruined their reputation. If they had ever been arrested, had an article written on them, the judge or jury would say there was no damage. Bernstein is scum, no doubt, He gets away with it though,

If tomorrow he says Michael Franzee and Michael Deleonardo killed Carmine Galante, and Franzese is running the Mafia today, they could not sue and win. That is why Scott Scumstein and Capeci plus the others get away with just about anything.

When the movie "Donnie Brasco" came out,John "Boobie Cerasani sued Sony and Tristar pictures,for libel damages based on his portrayal as a murderer in the film.
Early test screenings of the movie used his real name,but the theatrical release used the pseudonym "Paulie".
Cerasani was found not guilty of the charges brought as a result of the movie,after which he filed the suit.
Judge Denny Chin of the Federal District Court in Manhattan dismissed the suit stating that Cerasani was "the exceptional libel-proof plaintiff"
whose reputation "is sufficiently tarnished,that at most he could collect nominal damages"

Yes I remember the lawsuit involving Boobie. But for instance, Scott said that the administration of the Gambino Family met with the administration of the Philly mob in South Philadelphia in the Spring. Readers on Reddit are bashing him saying that no such meeting took place, even though he named specific people. So is he really getting away with making up grandiose lies like that? None of these guys he names are going to come forward and refute what he's saying?

If he's lying, he has one helluva imagination, for sure.

The guy has a law degree and is likely extremely familiar with libel and defamation laws.

He knows what he can and can’t say. I took some pre-law classes in college, it’s not difficult to figure out.

Why hasn’t he been sued? Think about it….

Okay, I still would expect someone besides a group of Redditors or bloggers to call him out. Someone, like, you know, people he's lying on. Maybe they're afraid of whatever repercussions could result from speaking out.

That is important, the damages collected, if any, wouldn't be enough to cover expenses. Plus it's tough for anyone to win a libel suit, almost impossible in the case of the people Capeic, Bernstein , and others could be lying about,. They also use the defense that they are quoting sources.

I would be fucking livid if they were making up these lies about me.

U.S. laws used to be hardcore but as @Jace already said, its different now....obviously for the worst
