'Ndrangheta, Camorra and Cosa Nostra “allies” in Milan: the Court of Cassation agrees with the prosecutors

MILAN Three suspects, including Gioacchino Amico, in the maxi investigation “Hydra” by the Milan DDA, centered on an alliance between alleged affiliates of the three mafias, Cosa Nostra, Camorra and 'Ndrangheta, in Lombardy, were arrested by the Carabinieri of the Investigative Unit, after the Court of Cassation rejected their appeals to the Review Court, which last October had accepted the accusatory system of the PM Alessandra Cerreti and the Prosecutor's Office led by Marcello Viola.

The Review
A decision of the Review that came after the investigating judge Tommaso Perna, instead , in October 2023 had rejected 142 requests for precautionary measures out of 153, ordering 11 arrests and rejecting the accusation of mafia association as a "consortium" of the three mafias, renamed by the prosecutors "Lombardy mafia system". After the first of a long series of hearings in the Supreme Court that will take place in shifts until mid-February on about forty positions, that is, on the suspects for whom the Review ordered precautionary custody in prison for mafia association, the provision rejecting the three appeals and imprisonment was carried out. And Gioacchino Amico was arrested , alleged head of the Lombard "unitary structure" on behalf of the Camorra of the Senese clan. Pietro Mannino, a presumed Cosa Nostra member, was also arrested, and Vincenzo Senese, already detained for other crimes, was notified of the order in prison.

«The alliance exists»
From the rejection of the first three appeals examined by the Court of Cassation, and pending the reasons, it can be said, however, that the Supreme Court has accepted the line of the Review on the alliance between exponents of the three mafias. And this after the "Hydra" case had also created a clash between the prosecutor and the investigating judge's office, following the rejection of the numerous arrests requested.

The long arm wrestling
The Review, last October, after the appeal of the DDA on 79 positions with a request for prison for mafia association, in the investigations of the Carabinieri of the Investigative Unit, ordered the precautionary custody of 41 suspects, including Paolo Aurelio Errante Parrino, 77 years old and who, according to the investigators, would have been the "point of connection" between the alleged "mafia system" in Lombardy and the "boss of bosses" Matteo Messina Denaro, who was his cousin on his mother's side and died in 2023. For Parrino the hearing in the Supreme Court is scheduled for next week and for all the other positions there will be hearings until mid-February. In the meantime, the suspects remain free, but this decision to reject the first three appeals of the defense seems to go towards accepting the reasons of the Review on the arrests to be carried out.

The Hydra Investigation
According to the judges, who in October accepted the appeal of the DDA, in Lombardy in recent years there has existed, both from a 'military' point of view with the most classic activities, such as extortion and drug trafficking, and with financial infiltration, a new and unique mafia association composed of alleged affiliates of the three mafias, with a sort of pact for shared business. They would have "transferred into the horizontal partnership all the genetic traits of the associations to which they belong". According to the Review Court, Giuseppe Fidanzati, alleged leader on behalf of Cosa Nostra, and Massimo Rosi, alleged top exponent for the 'ndrangheta, must also go to prison. For six positions, the precautionary measures had also been rejected by the Review Court due to the absence of serious evidence, while the remaining, or 32 in total, were not accepted only due to the lack of precautionary needs, with confirmation, however, of the serious evidence. CATANZARO The prosecutor of Naples Nicola Gratteri is a raging river, during the hearing before the parliamentary Anti-Mafia commission he talks about everything, from the dangers of the dark web, to the differences between the Camorra and the 'ndrangheta without leaving out a passage dedicated to justice between the Cartabia reform, privileges for bosses under 41 bis and wiretaps. On the difference between the mafias, always studied and fought, Gratteri says «There is one thing in the Camorra that is unthinkable for the ' ndrangheta : they move from one block to another. This makes investigations very difficult. In Calabria – Gratteri said during the hearing – it is unthinkable that a 'ndrangheta family decides to ally itself, at a certain point, with another group. Instead, in Campania I see a fairly fluid Camorra, it moves based on opportunities, business, business. The heads of the families also do business among themselves and below, the butcher shop, the street Camorristi, instead, kill each other". The prosecutor dedicates extensive analysis to the underworld in Campania but then returns with his mind to Calabria and his work at the head of the DDA. Wiretaps "are expensive but useful"
"Wiretapping costs the country 170 million euros. In the budget of a State, they are nothing. And no one tells you how much gold, banknotes, silver and collectors' watches are seized and acquired by the State." Nicola Gratteri returns to talk about the importance of wiretaps, a necessary tool to complete investigations and often able to reveal dark and hidden sides linked to the criminal galaxy. "The State makes money from it - he reiterates - and wiretaps, a colorful expression that I hear used, are a fairy tale, they do not exist. The prosecutor requests wiretaps and the judge orders them. An authorization is needed. We would not even have time, assuming they were possible, to do them." The prosecutor of Naples, then, gives a concrete example to dispel any doubts or fears about the alleged abuse of the tool. "If I have an environmental wiretap for mafia or drug trafficking and a public administrator, a regular customer, enters because he buys 100 grams of cocaine and speaks to the dealer about corruption, this is a confession but I cannot use the wiretap. If then a drug addict comes in half an hour later and buys 5 doses, 4 of which are to sell and one not to pay for himself and then says he stole a bottle of whisky from a supermarket, I can use this. A paradox! And the problem was there even during the government of the best, three years ago".

Award permits for bosses under 41 bis
Another very current issue: the award permits granted to those detained under the 41 bis regime. "Today there are 730 prisoners under the 41 bis regime in eleven different prisons. As far as I'm concerned, there are basically eleven different interpretations of 41 bis, where it happens that a prisoner can be better or worse off," says Gratteri. He adds: " For twenty years I have been proposing to create four facilities dedicated to 41 bis. Today there is only one in Sardinia. Another in Cagliari that is not opening. Three more prisons with 5,000 places each would be enough and we would no longer be talking about overcrowding. 41 bis is more of a slogan. It was created to prevent mafia bosses from sending death messages. I would be much more rigorous but high security must work ." The president of the Parliamentary Anti-Mafia Commission Chiara Colosimo intervened on this point - speaking to AdnKronos . «Gratteri has opened a gap that we will certainly work on, I have already given the mandate to look for all the circulars he cited because it is clear that we must build a 41bis that is the same in every location».

The reforms
The prosecutor dedicates a passage to the Cartabia reform that "has not weakened the currents within the judiciary and the CSM, it has only increased spending because there are 10 more members in the CSM". According to Gratteri, " the reform of the CSM is the mother of all reforms. If the system continues not to work, I believe that the lesser evil is the dry draw . LAMEZIA TERME It is on the Bogota-Bologna axis that the latest blow against international drug trafficking managed by alleged members of the Calabrian 'ndrangheta was carried out. This is one of the most important aspects that emerged from the investigation by the District Anti-Mafia of the Emilian capital, which led to the arrest of 15 individuals, including the two Albanian cousins, Bashkim Sula (class of '87) and Sokol Lumi (class of '86), Daniel Palladino (class of '01) and the Calabrian Salvatore Gaetano (class of '81) from Locri, all of whom ended up in prison.

The cargo at El Dorado
The investigators followed the trail that from a load intercepted at the “El Dorado” airport in Bogota led straight to Italy: 6.5 kilograms of cocaine destined for a person from Bibbiano. But it is the recipient’s number that allowed them to reconstruct – at least according to the prosecution – what would be a group very well established in the importation from abroad and subsequent resale «of large quantities of cocaine, marijuana and hashish. The number, in fact, was registered to Daniel Palladino, who ended up in the interceptions starting from 8 October 2020, two days after the discovery of the load in Colombia. The accusatory theory that convinced the investigating judge is based on the interception activity that would have allowed them not only to confirm that the batch of cocaine seized in Colombia was actually headed to the Reggio Emilia area , but also that the recipients of the very precious load were above all the two Albanian cousins ??and the Calabrian Salvatore Gaetano .

«A powerful Calabrese friend of mine»
"Kaqolo I have a very powerful Calabrian friend of mine. They want to bring in some white from Latin America. Your friend has the possibility of bringing it in. They also have the exit." Fundamental, also in this investigation and like all those related to international drug trafficking, the decryption of the Sky ECC chats . Thanks to their analysis, in fact, the investigators traced the conversation held by Bashkim Sula on September 13, 2020, about a month before the discovery of the load in "El Dorado" . As reconstructed by the prosecution, in fact, the Albanian would have asked an unidentified compatriot for logistical support in relation to a batch of "white", which "a very powerful Calabrian friend" was about to bring to the national territory "from Latin America", for which the "exit" was already ready. From the messages exchanged, however, the investigators were unable to understand whether the "powerful Calabrese collaborator" they had mentioned was actually Salvatore Gaetano.

From 14 to 16 thousand euros of "easy earnings"
Beyond this aspect, however, the investigators still managed to intercept other conversations regarding the load seized in Bogota, dating back to a few months later, March 2021, through a Trojan injected into Sokol Lumi's device which, at the time, was near Salvatore Gaetano's home in Sant'Ilario d'Enza, in the Reggio Emilia area. The two refer to one "package at a time" to be "worked" to make "14-15 thousand euros of profit" and, encouraging each other, talk about "serious guys" with whom they could make "15-16 thousand euros" a month as a start. Furthermore, during the intercepted conversation, Lumi criticized his compatriot Sula because, after the seizure of the cocaine load in Colombia, he had in fact abandoned his residence to go and live in a hotel "fearing possible checks" . A conversation that, once again, according to the investigators, would confirm «the involvement of Sokol Lumi, Bashkim Sula and Salvatore Gaetano in the arrival of the drugs later seized in Colombia». LAMEZIA TERME Livorno confirms itself – together with Gioia Tauro – as the most important port chosen by the 'ndrangheta for the arrival of large loads of cocaine from South America. The latest seizure in chronological order demonstrates, once again, its crucial role in the dynamics of international drug trafficking: 217 kilos of very pure cocaine, divided into almost 200 blocks with a commercial value on the drug dealing streets of over 60 million euros. The blocks of cocaine, explain the men of the Guardia di Finanza supported by the Customs agents, were hidden inside a container containing wood, unloaded from a cargo ship coming from South America and headed, needless to say, to Calabria.

Seizures on the rise
A seizure, therefore, large and that fits into a scenario that appears increasingly clear. Already in November 2024, in fact, a blitz coordinated by the District Anti-Mafia had led to the arrest of 30 people, all believed to be part of a criminal association aimed at international drug trafficking and involved in a series of episodes of importation, transportation and sale of drugs, of which 23 ended up in prison. The investigation activity had allowed the seizure of over 2 tons of cocaine, 45 kilos of hashish, 20 kilos of marijuana. Narcotics that - once on the market - would have earned around 70 million euros to the criminal gang.

The Anti-Mafia Investigation
The investigation conducted by the District Anti-Mafia Directorate in recent weeks had revealed a complex international drug trafficking network that, starting from Colombia, arrived on the Italian coasts, with the port of Livorno as the main distribution point. The cocaine, coming from Ecuador and managed by an Albanian broker, had been sent to Europe thanks to the collaboration of Italian criminal organizations, including the 'Ndrangheta, the Camorra and the Sacra Corona Unita. An integral part of the investigation were the statements of the repentant Errico D'Ambrosio, affiliated with the 'Ndrangheta Molè gang and in the past with the role of "Vangelo". It was he who confirmed that he had participated in two cocaine recovery operations in the port of Livorno, revealing the financiers and accomplices involved. According to the repentant Ernesto Modafferi, known as “Tommy”, a member of the Molè clan, the financiers included Mario Palamara (arrested in Spain in 2022) and a mysterious Albanian drug trafficker, known by the nickname “Porsche”. The investigations would later also reveal the use of sophisticated encrypted communication devices, including Israeli cryptophones, for conversations between the bosses and the emissaries. These devices, purchased in Spain at a price of 5,000 euros each, were used to coordinate drug exfiltration operations.

Joint venture between 'ndrangheta and Albanians
The investigation by the Florentine DDA had therefore brought to light a sort of joint venture between 'ndrangheta members and Albanians , reconstructing two cells that were essential for the recovery of the drug load: on one side the "recoverers" and the "supervisors", on the other the "senders". A profitable business, despite the numerous seizures carried out, and which would have seen the participation of at least three Calabrians: GL (class of '78) from Polistena, MP (class of '69) from Melito Porto Salvo and EM (class of '75) from Gioia Tauro, all three arrested. Today the new maxi seizure of cocaine that demonstrates how important the work of the police and investigators is to dismantle the huge and infinite business linked to international drug trafficking. VIBO VALENTIA Found dead in Pannaconi, in the Vibo Valentia area, Antonino Barbieri , alias “Camera”, considered by the Catanzaro DDA to be “a leading member of the ‘ndrangheta” and accused – at large – in the main trials against organised crime in the province of Vibo Valentia. The discovery took place in the hamlet of Cessaniti, a municipality on the outskirts of Vibo Valentia, last Monday afternoon. The Carabinieri and 118 went to the scene, which confirmed his death. Death may have been due to natural causes, but an autopsy has been ordered to confirm this hypothesis.

The accusations of the DDA
Defendant in both Rinascita Scott and Maestrale Carthago, “Camera” was considered a leading member of the Vibo Valentia 'ndrangheta, in particular belonging to the Zungri club. The collaborator of justice Andrea Mantella had spoken of “Ninone” as «belonging to the Accorintis», also by virtue of his relationship with the boss Peppone Accorinti, believed to be the head of the 'ndrina. An accusation that had been rejected by the judges of Rinascita Scott, acquitting Barbieri in the face of a request by the DDA for 20 years in prison. The latter had then appealed, considering the evidentiary framework based on the statements of the informants sufficient. The Absolution in Rinascita Scott
The opposing opinion of the judging panel, which had deemed the testimonies of the collaborators insufficient and the family relationship with Peppone Accorinti "absolutely irrelevant". In the appeal, the DDA also proposed the subsequent statements of the repentant Antonio Accorinti, who had identified the Barbieri brothers as "referents of the 'ndrangheta structure operating in Pannaconi". Sentences of 98 years in total and 35,350 euros in fines for 21 defendants in the “Radici” trial, on the infiltration of organized crime in the Riviera: they were issued today by the criminal section of the Court of Ravenna, presided over by judge Cecilia Calandra. The council chamber had met on Monday. The Prosecutor's Office, with the prosecutor of the DDA of Bologna Marco Forte, had requested sentences of over 110 years. The accusation concerns, among other things, the control of premises on the Riviera, managed with mafia methods to launder money for organized crime. Among the heaviest sentences are those of 13 years and 3 months for Saverio Serra (12 thousand euros in fines), considered a figure linked to the 'ndrangheta clan Mancuso of Limbadi and currently in prison (for him the prosecutor had requested 15 years and 11 months). Next up are Francesco Patamia, sentenced to 11 years and 2 months (a fine of 9,200 euros), and Rocco Patamia with 10 years and 6 months (a fine of 8,600 euros). Francesco Patamia was a candidate for the Chamber of Deputies in the political elections with the list 'Noi moderateti' and the prosecutor's request for him was 13 years, while for his father Rocco 11 years and 10 months were requested. Among the civil parties in the trial, as a victim of threats, is the former Serie A goalkeeper Marco Ballotta who will be compensated 3 thousand euros by Giovanni Battista Moschella, sentenced to 5 years and 10 months in prison.

The reactions
"I am very pleased with the outcome of this trial. Even before the financial compensation, the distance and the strength of a living economic fabric, resistant to any type of incursion by the underworld, are clearly stated. Our strength is in the institutional network, between institutions, associations, and law enforcement. The message is clear: our territory is attentive and ready to defend honest work and legality in the broadest sense of the term". This is how Matteo Missiroli, mayor of Cervia, assisted by the lawyer Chiara Rinaldi, comments on the ruling of the "Radici" trial in Ravenna. The Municipality is among the entities for which the judges have established compensation for damages. "As mayor - he adds - I take this opportunity, together with the internal legal service, to thank the invaluable support of the professionals who have always supported us with excellent results".
Cgil Emilia-Romagna and the Chamber of Labor of Forlì/Cesena, present at the ' Radici ' trial as civil parties, represented by the lawyers Andrea Ronchi and Andrea Gaddari, «express satisfaction» for the ruling of the Court of Ravenna, «at the end of a trial that has demonstrated how serious labor exploitation and gangmastering are realities present in our territory even in sectors such as tourism, hotel reception, and confectionery craftsmanship». The Cgil emphasizes how «even before the trial it had represented the exploited workers and reported the seriousness of the facts to the authorities, playing an active role as a sentinel of the territory. Today's ruling, whose reasons we will read carefully once filed, recognized the right to compensation for damages to the union organization as well as to the worker who had courageously constituted himself as a civil party. Once again it has been demonstrated that, where there is no legality, the union is damaged in its constitutive role of representation and protection of workers and therefore we will continue our commitment to combat the degenerative phenomena that take away people's freedom and dignity".

This is what the president of the Court of Appeal of Catanzaro, Concettina Epifanio, wrote in her report, on the occasion of the inauguration ceremony of the judicial year of the District.
As the Public Prosecutor of Catanzaro, Vincenzo Capomolla, writes, «the 'ndrangheta is now recognized as the most dangerous and powerful criminal organization among the “mafias”: this is in relation to both the volumes of business achieved, and in particular in relation to international drug trafficking, extortion activities - having as their object both private commercial activities and the performance of public contracts -, and the ability to influence economic activities - precisely because of the massive investments of dirty money in legal commercial and entrepreneurial activities -, and the ability to infiltrate and influence civil society and public administrations».

The numbers
Therefore - it is stated - the pervasive presence of the mafia phenomenon generates an impressive series of investigations, proceedings and trials, as demonstrated by the data already reported in other parts of this report, to which some data reported by the District Anti-Mafia Prosecutor of Catanzaro must be added here. In particular, the pending proceedings as of 30 June 2024 against known subjects were equal to 615, with an increase of 23 proceedings compared to the figure for the previous year (when there were a total of 592). Those pending against unknown subjects stood at 264 proceedings , also in this case with a greater occurrence of 8 new registrations compared to the same date of the previous year. The intense activity carried out by the Catanzaro District Anti-Mafia Prosecutor's Office in the reference period is demonstrated by various aspects, including: the number of precautionary measures requested against 1,086 suspects, with 714 accepted for custody in prison, 123 house arrests, and 6 for non-precautionary and interdictory measures. And then by the impressive number of hearings (2,071) before the district GUP, in the debates held before the 7 Tribunals and the 2 Assize Courts (Catanzaro and Cosenza) of the district, without counting the hearings before the Review Court and before the GIP for the validation of arrests in flagrante delicto and detentions pursuant to art. 384 cpp

The Mancuso clan
Dozens and dozens of proceedings that the District Anti-Mafia Prosecutor's Office has dealt with in the year in question. In his report, in fact, the prosecutor Capomolla lists and illustrates analytically the intense activity carried out by his office, district by district. Starting with Vibo Valentia.
Here, in fact, there remains a "very high criminal density, probably the highest in the entire territory , especially if evaluated in relation to the number of inhabitants and the smallness of the territorial extension", as stated in the report. Numerous are the 'ndrangheta gangs that oppress the district, "extending their branches throughout the national territory and also abroad. The historic Mancuso gang is hegemonic, composed of the 11 sons of the original founder and their descendants, now in their fourth generation, with numerous affiliates and a congeries of associated gangs" , as stated.

The operations
And among the many proceedings that have involved the Vibo Valentia area, the “Rinascita-Scott” trial stands out for its exceptional size, having hit the headlines for the execution of a precautionary measure that involved 334 people and a total number of approximately 450 subjects. The “ordinary section” of the trial, which had as its object the crime of association and numerous crimes resulting from the criminal activity of the Mancuso gang and the satellite 'ndrine operating throughout the Vibo Valentia area and in various areas of the national territory, with investments beyond the border, concluded in November 2023 and the motivation was filed on 16 May 2024. And then the other important proceedings: “Dedalo-Rinascita 2” involving three different associations, with the first sentence issued for the 58 defendants, last 1 December 2023, who had chosen to be judged with the ordinary procedure. There is “ Assocompari ”, a continuation of the “Rinascita-Scott” investigation and the result of international police cooperation with Hungarian, Cypriot, French, Danish and British authorities and judicial cooperation with the coordination of Eurojust, which also made use of the collaboration of the Financial Intelligence Unit (UIF) of the Bank of Italy and the financial support of the @ON project. The proceedings involved a series of defendants, 5 of whom opted for the abbreviated procedure and the sentence was issued on 14 May 2024, with an appeal underway while the ordinary section is still pending before the Court of Vibo Valentia.

The hands of the clans on tourism
The “ Maestrale-Carthago ” trial is still underway, concerning the 'ndrangheta gangs of Mileto and Zungri and the 'ndrine of Briatico and Cessaniti, particularly active in extortion against construction companies and commercial businesses operating in the tourism-hotel sector. It has brought together the other investigations “Olimpo” and “Imperium”, involving 285 defendants, 91 of whom have chosen to be judged with the abbreviated procedure and the remainder with the ordinary procedure. Finally, there are the “ Porto Salvo ” investigations which allowed us to reconstruct four very serious bloody events that occurred between 2008 and 2012, closely linked to each other and which involved a series of individuals placed at the top of at least four 'ndrangheta articulations and “ Habanero ”, in the context of which on 14 June 2024 a custodial order was executed against 14 suspects for the crimes of mafia-type armed association, multiple homicide, external competition in mafia association and for other serious crimes, all aggravated by the mafia method and purposes. But it's not enough for Fazzalari to demonstrate to everyone his power and that of the family to which he is affiliated and enlisted as a killer. A few days pass and, disguising himself as a carabiniere, he sneaks in among the grieving relatives and kills 24-year-old Roberto Grimaldi, wounding his 14-year-old sister Rosita. A bloodbath that went down in history as the Good Friday massacre of 1991. A mafia peace decided by the leaders of the 'ndrangheta in the Palmi super-prison follows. In 1996 he definitively becomes a woodsman, accused of numerous murders, drug trafficking, mafia-style criminal association, robbery, weapons. With his brother Domenico and his cousin Salvatore, the boss remains one of the top exponents of the Avignone-Zagari-Viola clan.
