The lawsuit won't prevent Sony from having the vibration in their controllers, per se. They're basically being sued because some company claims that Sony stole their technology. Basically, Sony will have to come up with their own vibration technology.
As for the new "bat-a-rang" controller, I don't like it so much. The Dual Shock 2 is hands down the greatest gaming controller, IMO. I think they shoulda stuck with that design, with maybe a few minor adjustments.
