Yes, they can because a verdict was never reached. So no double jeopardy. The defense may have to agree to the mistrial, if I remember right. Which I have no doubt they would.

Jesus that would suck. I think if it was a mistrial i would rather just see if i can get a good plea deal. Especially if i didnt make bail. How long would it take to start another trial?

I guess it depends on how quickly the prosecution wanted to do it. They could probably bring the charges again almost immediately. But I wouldn't be surprised if they waited to see if they could get Nicodemo to flip. With him, they could include murder charges against several of the defendants and then the stakes go up considerably.

I think Nicodemo will stand up enough to go to a trial. But once hes found guilty he'll flip.
