That gun is going to haunt him. If he had just gotten rid of it i would say he could easily beat the case, but that gun that they say can be ballistically tied to the body is going to hang him.

At the very least he's an accomplice to a homicide. And if they can prove it was a planned murder to get rid of a witness he's as guilty as the guy who pulled the trigger.

People now seem to think it was a sanctioned hit so the interesting question to ask is who sanctioned it? Seems to me it had to have been one of 3 people, Ligambi, Merlino or Mazzone.

I doubt Ligambi because he was on trial and it happened right as the case was going to the jury. So i think it was either Merlino or Mazzone or maybe both that gave Nicodemo the ok to take DiPietro out.

Yeah, the "during the commission of a crime" thing death makes it felony murder, right? Just like if someone died during an armed robbery.

I am very interested to see how this ties in with the decision to retry Ligambi. We all know that being on trial doesnt stop someone from ordering a hit. And (although I am not certain) I dont know that Ligambi himself had to order it. Even if Merlino or Mazzone ordered it, if it was done on behalf of Ligambi and/or "the family", there is a possibilty that the murder can be added onto charges of Ligambi. (Im not absolutely certain, and it would be risky for feds to do this because it could water down the other charges in jury's mind).

The Feds decision to retry Ligambi (in APRIL!) is interesting. And you can be sure that Nicodemo is feeling pressure from all sides (The State, The Feds, and The Family). Whether he was the trigger man, was there, knew about it, or had no clue, is irrelevant. I wouldnt wish his situation on my worst enemy.

Yup thats felony murder. Its can result in some very sad outcomes. While I am very conservative, hard on crime, kind of lawyer, I wont deny there are at least 2 guys doing life without possibility of parole (which is just that in PA) who shouldnt be there. Not that they didnt kill someone - they did - but circumstances of the cases would make you cry yourself to sleep.

How about a guy doing life with out parole for a non violent crime that I believe may have been his first arrest. I have mentioned him on here several times as his story interests me, especially being Long John's son is George "Cowboy" Martorano. Pleads guilty and the judge screws him cause of who is father is basically. Thats not justice! But yet let a little hoodlum murder another little punk in North Philly and he gets 10 years.

Neil Ferber was sitting on PA death row for the mob murder of Chelsais "Steve" Bouras. I forget how long he was locked up until they finally figured out he had nothing to do with it. Pretty crazy an innocent guy can end up on death row and possibly be executed.

Jacklynn they set the date for the retrial but i read they haven't actually decided yet if they're going retry them on the charges that weren't decided. It was just a formality that they set the trial date but it's not a done deal yet.

The judge is trying to get things moving they said.

Right, according to George Anastasia's blog the decision to retry them will be made by the Justice Department down in DC in the near future. But it's not a done deal yet.

I am so frustrated with (old) news coverage of philly mob. I cant find any pictures of the old hits from the scarfo-merlino-natale wars. I have Bruno's scene (obviously), Phil Testa's house, Falcone in trunk, Ron Previte's car all shot up from Stanfa ambush..Thats it. Well and Tony Bananas's car.

He got a raw deal. GA had mentioned on one of his sites that the reason behind that was Scarfo and Bobby Simone. I have the last mouth piece that Bobby Simone wrote its a pretty good book and he does mention something in regards to that as well that there wasn't any beef with long john or his son, but who knows.

His father was indicted recently and is supposedly pleading guilty to the ticket fixing scandal for the traffic court. That traffic court in Phila is racket to begin with. I love how they mail you RED LIGHT TICKETS...and they have a CRYSTAL CLEAR PICTURE OF YOUR LICENSE PLATE,yet if someone is getting mugged raped shot or whatever they have grainy surveillance footage that can barely make out the individual

One of the reasons they won't cut George Martorano any slack is because Tommy DelGiorno said George was one of the 2 shooters who murdered Steve Bouras and his girlfriend. He said Frank Vadino was the other shooter. Vadino was with Long John and part of his drug operation.

If you youtube one of the Philadelphia documentaries they show a few videos of that hit. I can't remember which documentary though. Philly mob has a lot of firsts in history. Some of the dumbest firsts...

If i was a cop i'd probably want to find out where Dom Grande was at the time of the shooting. But it could of been any of the many guys from south philly looking for a way to earn a button. But personally i would start with Grande.

Baldinos would be worth catching up with too probably

I doubt the Baldino's would step up like this, aside from the blood ties it is not in their nature. Both kids grew up with money, they own a club and run a very popular sandwich place in South Philly, neither one has the hunger or the need to step up like that.

Has to be somebody much higher up on AN's level, they haven't hit anyone in years so I doubt they would use somebody not experienced in this kind of thing.
