I don't think Nicodemo thinking that he can beat the charge is all that crazy. Remember this is a state murder charge not a federal rico. Something Nicodemo said on wiretap about bookimaking back in '07 doesn't matter, the only thing that matters is if on that day did he shoot Dipietro. Bringing in Monacello and having him say that hes a mob member won't matter. No eye witnesses to the crime, now the gun was found in his car but im sure his lawyers can conjure up something that could at least make going to trial not a long shot. If the gun wasn't in his car and I don't know why it wasn't than no case, I wont be surprised if the state offers him 7-10 years before trial.

7-10? I don't know Bobby. The fact is the gun was in his car, and that car was the same car spotted by an eyewitness leaving the murder scene. If they offer him 10 years, he should consider himself as lucky as someone who hit the mega millions jackpot. Also, even if he was stupid enough not to take a plea deal and went to trial and by some act of God beat the case, double jeopardy does not apply to the feds picking up state acquittals. Meaning they could try him for the murder in federal court after his state acquittal, which if he was lucky enough to get, the feds would 100% do.

I think someone got the tag number. But the question is can anyone id Nicodemo and put him in the car at the time of the shooting and the witness getting his tag? If not then they can always claim some off the wall bullshit like he's being framed. But if they do have him id'd at the scene then i'm not so sure why he thinks he's going to beat the case. Yeah his lawyers can come up with whatever they want, don't mean its gonna work. Shit they could say Santy Clause was the shooter and rudolph drove the getaway car but don't mean the jury gonna buy it. They have a shit ton of evidence on him including the weapon. IF they offered him a deal to plead out, he shoudl take it. Whether he was the shooter or not dont make one iota a difference. Aiding an abetting a murder is the same for all intents and purposes.

Why are the offering him a deal at all? They have the murder weapon for god's sake. And as vinnie said anyone involved in the conspiracy is guilty of murder 1 period regardless of what they actually did.

No, I would actually have to write the court to get documents. There is no PACER. And if there anything vaguely confidential or ratting going on- its a sealed record.
