Sunday, January 19, 2014 Ligambi Jury Reaches Partial Verdict; Specter of Third Trial Rises
"Uncle Joe" Ligambi could be facing trial number three... The jury in the racketeering conspiracy retrial of old-school Philly mob boss Joseph "Uncle Joe" Ligambi and his nephew, George Borgesi, has reached a partial verdict, but it won't be made public until Tuesday (Monday is a holiday).
Before recessing on Friday, the jury sent the judge a note saying it had reached a verdict on two of the five counts, but remained hung on the other three.
The note highlighted that there was a "firm difference of opinion" over the remaining charges.
Ligambi, 74, is charged with racketeering conspiracy, two counts of illegal gambling and one count of witness tampering. The case against him includes secretly recorded conversations, most of which involve other mobsters as well as cooperators.
Borgesi, 50, faces a single count of racketeering conspiracy that is built primarily on informants' testimony; the consensus of court watchers says that Borgesi's fate depends on whether or not the jurors believe any of the two turncoats that provided testimony during trial.
If jurors voted for guilt on the conspiracy charge, it could lead to sentences of 10 years or more.
But if racketeering conspiracy is among the three charges on which the jury is hung -- which is what happened in the first trial -- the issue will become whether the government would opt to try the two defendants a third time.
For context, John Gotti Junior was hit with four racketeering trials, all of which ended in mistrials. In January 2010, federal prosecutors announced that they would no longer seek to prosecute Gotti for the charges. However, unlike in the Ligambi trial, the charges against Junior included serious violence: murder, drug trafficking, loan sharking and kidnapping. However, unlike in the Ligambi trial, the charges against Junior included serious violence: murder, drug trafficking, loansharking and kidnapping.
The issue of bail would likely be raised if a third trial becomes the potential scenario; the two defendants have been held since May 2011.
According to Anastasia, one friend told Ligambi: "I cut two pounds of soppressata (for a victory celebration). It'll wait til Tuesday."
Ligambi smiled and nodded.

TUESDAY, JANUARY 21, 2014 Snow Stalls Mob Trial Deliberations By George Anastasia For Bigtrial.net Jury deliberations ended shortly after they began this morning in the racketeering conspiracy retrial of mob boss Joe Ligambi and his nephew George Borgesi. With snow beginning to swirl outside the federal courthouse at 6th and Market Streets and with predictions of a snow storm that would dump eight to 10 inches on the city, Judge Eduardo Robreno dismissed the panel at 10:30, about an hour after deliberations began. The jury of 11 women and one man is due back tomorrow, but with snow predicted to continue through tonight and with strong winds and dropping temperatures to follow, another delay is possible. The jury has deliberated for seven days after hearing eight weeks of testimony. On Friday it announced that it had reached a verdict on two of the five counts it is considering and had a "firm difference of opinion" on the other three. Robreno urged the panel to continue deliberations. It could not be determined what charges have been decided or whether the jury has voted to convict or acquit. Borgesi, 50, faces one count of conspiracy. Ligambi, 74, is charge with conspiracy, two counts of illegal gambling and one count of witness tampering. Both men have been held without bail since the indictment in the case was handed up in May 2011. Their first trial ended with a jury unable to reach a verdict on the counts now pending. In that case, four other defendants were convicted and one was acquitted. That jury, after three weeks of deliberations, delivered not guilty verdicts on 46 counts, guilty verdicts on five and hung on 11 others, including the charges against Ligambi and Borgesi that are now being retried. Yea at this point time served seems like an appropriate sentence Never happen. They either walk on a not guilty verdict, or this judge maxes them out on a guilty one. I see no in between.

While I don't share the sentiment of others on here that the judge has been trying to screw these guys, I do think that if they are found guilty he is going to max them out.

This is beyond a joke and yes the judge is hoping to max them out, he is a Jag off and this trial is hurting his reputation in Philadelphia For being biased. They def don't want to let these guys go and he's been delaying all these court days with a smile on his face. First the stupid cat(if there is even one or if so maybe dead by now), then they declared mistrial and he sent them back to work, and now the snow!,what? people in philly won't survive in snow? Lol, He will delay this trial for many more reasons before it's over, Georgie and Joe must be deliriously laughing about how this is playing out, while there family is suffering from not knowing the uncertain, They have been held for 3 years on this case, wtf is that, lucibello and Angelina will be home soon and merlino will be off supervised release in March, this trial will end when Scarfo sr is paroled lol FUCKING ASSHOLES LOLLOL

If anastasia gets the boot from the scarfo case they'll have other reporters in the courtroom. I think those guys are done for - scarfo and pelullo, just going thru the motions I agree Jose...these guys...Scarfo Jr and Pelullo are screwed. Scarfo is gonna get hammered hard at his sentencing. I used to know the lawyer that was charged in the case Don Manno a little bit, and to me he always seemed to be a pretty decent guy. I hope he beats the case....i was pretty surprised he got involved in it in the first place. I forgot George A said he might not be able to cover the trial, so i really hope one of the other local crime reporters does.

I don't want to answer for JCB or anything. But a lot of people feel this way. Ligambi gets by on a "no penchant for violence" reputation publicly, even though he served 10 years for killing Frankie Flowers and got off on a technicality. He's a real (or wannabe, whatever you choose to believe) Angelo Bruno type. Borgesi is known as a loose canon with a mean streak. A real student of the "Nicodemo Scarfo School for the Incompetent Napoleon Complex Wiseguy". People in Philadelphia and New Jersey have seen more than enough of this type of gangster and they don't want to see another one walking around South Philly.
