No one knows if Nicodemo will flip ,I do not care if you are from Alaska, Jersey ,NY, Philly you don't know.He can not let his wife know .How can anyone say otherwise. If this guy has 1% of him that is considering talking (then he is a candidate)he has all the reasons to (wife kid etc.) The Feds are relentless in what they do. My point exactly, Serp. That's what we get for being like-minded old men  . The State's done with him, the Feds aren't. That's all I was trying to say. It looks like he'll stand up. The Feds will be dangling some very tempting bait in front of him in the coming months. The State's done with him, the Feds aren't. Especially if they think they can get to Merlino. Now I reiterate that some solid Philly people have told me that he'll stand his ground. But the Feds will be breaking his balls for awhile at the very least.
And Beans, the short answer to your question is that the Feds can pressure the State to release a guy to them any time they want. The State doesn't technically have to comply. But they usually do. And in mob cases, I can't think of a single instance where they didn't comply. Dead on as usual. He could be wrapping up this case because the Feds asked him to for all we know, the flip angle is still not out of this equation. The reason I thought he could flip (I don't know him from any other these days) was like Oscar said, because of that bombshell wife and those two little girls (I think they were girls?). Not seeing them grow up makes a difference. He can do his time and get out a divorced and lonely old man with grown up girls that want nothing to do with you or flip and hope to be with his wife and kids. He loses either way honestly.

Nicodemo will be cooperating by year 2 "at most." In the grand scheme of things, he was a nobody in the landscape of OC. After two or three visits from that hot wife and kids, the Feds will be licking their chops! This guy can't do 25 years.

Harry The Hump's guy who rotted in State Prison AFTER becoming a Federal rat was Victor DeLuca.He ended up staying in for the full length of his minimum sentence----which was 18 years---due to the fact that he'd already been sentenced when he decided to flip.Like Nicodemo,he was the driver for the attempted hit on Sal Testa.The shooter in the case only got 4 years because he flipped before he was sentenced,even though part of his deal included pleading guilty to an additional murder in which he was also the shooter.DeLuca even had a serious bout with cancer during his incarceration and still wasn't freed until his minimum was up.Harry The Hump got life,but never lost his sense of humor.When DeLuca lost his voicebox to cancer,Harry had word sent to him that it was about 10 years too late !!! I don't know if things have changed in the past 30 years pertaining to the Feds influence over State justice----you never know with all the Federal funding that goes to State corrections programs---,but if not,it wouldn't do Nicodemo any good to flip once he's formally sentenced.At most,all they'd be able to guarantee him would be a good word with the parole board to let him out for sure at the end of his minimum term.

In other news, despite what some people from foreign countries say (and tout like its gospel) business is booming in south philly and there's all types of guys running around. I love how people are so dismissive of philly, as if there is just no possible way anyone is making money, haha. There's like a hundred guys running around a 7 mile radius making money and feeding like 8 guys above them. If there was nothing out there why bother? Exactly, I always hear it like philly is 3 bums fighting over slot machines, like these guys went to war, killed, and have died over nothing, yeah right.

I know that after 2 years of sentencing in fed court you can't start cooperating. Famous turncoat burt kaplan case example. He's 7 yrs into his 15 for weed. The feds needed him so bad when Burt told them he paid to have another inmate assumed the feds indicted him and used that crime as a way to get him the 5k letter for resentencing. Don't know how the state does it but the philly state let 2 federal rats rot in there state system after the fedset them go only for the pa. Doc to hold them on the state charges roger vella did like 10+ years and harry hunchback guy how shot sal tests the turned fed rat. They still need a 2 guy to help nicodemo story's. To the contrary, Chucky Porter, former underboss to Mike Genovese in Pittsburgh, started cooperating after 2+ years in federal prison after his 1990 RICO conviction. He never testified against anybody, but he led the FBI down the road to dismantle operations in Youngstown, West Virginia and quite a few gambling operations in the greater Pittsburgh area. Bottom line, if Nicodemo has info about the hit on Johnny Chongs, the Feds will listen...I don't care how far into his sentence he is. Same state. And I could tell you that NOBODY expected Chucky to talk, but Phil Leonetti was one of the guys who testified and did a lot of damage. If the FBI can solve a mob murder, they'll do it for the publicity.

The feds have a limited ability after a sentence is given by a state of PA judge to overturn or otherwise limit the terms of confinement. They are separate, sovereign jurisdictions with different rules. A judge in PA would have absolutely no statutory duty to even read or consider a 5k letter in resentencing. In fact, there may be mandatory minimum restrictions against it. After PA gives the sentence, there would be big obstacles to changing it. That makes Tony less likely to rat, knowing the consequences are set in stone. However, the feds could try him again. As for double jeopardy- the feds can't try him again on the murder. However, they could roll the murder along with anything else they know into a racketeering case.

Should probably ask Mr. Kierney. I guess if you're Italian, you should be in prison. I've read the RICO Act, and I can tell you it's more appropriate... for some of those guys over in Washington than it is for me or any of my fellas here

Business is booming in Philly? How do you determine that? How could you possibly know that? No family today is taking in what they were even 20 years ago. Philly has no labor racketeering and the Italians aren't dominating the OC scene there. What's your source? A bunch of nickel/dime wiseguys shaking a few people down, selling some drugs or running a small book.
